Allocated maternity leave from the mother

An eligible mother may allocate from 1 to 7 days of her maternity leave benefits to the child's father under RA 11210.

This is separate from RA 8187 and requires the mother's election plus written notice to the employers concerned.
These days may be continuous or intermittent and must be used within the mother's maternity-leave period.
Maternity-leave allocation under RA 11210 is not available for miscarriage or emergency termination of pregnancy.
How the extra leave works
The father's employer grants paid leave for the allocated period. For an SSS-covered mother, SSS pays her maternity benefit for the period that was not allocated.

The calculator estimates gross paid-leave pay using the father's daily rate. Normal payroll deductions, if applicable, are handled through payroll and are not deducted per leave day in this tool.

This is a gross-pay estimate. Normal payroll deductions may still apply through the regular payroll process. Thirteenth-month pay is a separate benefit and is not added to this leave estimate.

Can a father receive up to 14 paid leave days?

Potentially, yes. A father who qualifies for the 7-day paternity leave under RA 8187 may also receive up to 7 days allocated by an eligible mother under RA 11210. The allocated maternity-leave benefit is expressly over and above the paternity leave provided by RA 8187.

The extra 7 days are not automatic. The mother must elect the allocation and the required written notice must be given.

What is regular paternity leave under RA 8187?

Republic Act No. 8187 grants a qualified married male employee in the private or public sector 7 days of paternity leave with full pay for the first four deliveries of his spouse with whom he is cohabiting.

For RA 8187, delivery includes childbirth or miscarriage. The employee should also comply with the law's employer-notice requirements.

What are allocated maternity-leave days under RA 11210?

A female worker entitled to maternity leave benefits may choose to allocate up to 7 days of those benefits to the child's father, whether or not she is married to him.

For an SSS-covered female worker, the father's employer grants him leave with pay for the allocated period. The leave may be taken continuously or intermittently, but not later than the mother's maternity-leave period.

This allocation option does not apply to miscarriage or emergency termination of pregnancy.

What if the father is not married to the mother?

An unmarried father does not receive the regular RA 8187 paternity leave on that basis, but an eligible mother may still allocate up to 7 days of her maternity leave benefits to the child's father under RA 11210.

If the father's daily rate is ₱900, he uses all 7 RA 8187 paternity leave days, and the mother validly allocates another 7 days under RA 11210:
