Cohabitation Rule

The Cohabitation Rule disqualifies a surviving spouse from receiving the survivorship pension if they enter a new live-in or common-law partnership. SSS considers cohabitation as equivalent to remarriage because it implies the presence of financial and emotional support from a new partner.

SSS may require affidavits, community certification, or investigation to evaluate allegations of cohabitation, especially in disputed claims.

This rule protects the survivorship pension fund and ensures that benefits are awarded only when dependence is genuine.
