Quick answer
If a deceased SSS member still has an outstanding Salary Loan, the current SSS Salary Loan rules allow SSS to recover the outstanding balance including interest and penalties from applicable SSS benefits.
When the member or beneficiaries file a final benefit claim such as Death Benefit, SSS states that the outstanding Salary Loan balance, including interest and penalties, shall be deducted from the final benefit proceeds.
The important number is therefore not the original amount borrowed. It is the outstanding balance recognized by SSS at the time the claim is processed.
What the current SSS Salary Loan rule says
SSS can recover the outstanding balance
If the Salary Loan remains wholly or partly unpaid upon maturity, SSS may collect, deduct or withhold the balance, including interest and penalties, from benefits due to the member or beneficiaries.
Death is specifically listed
For a final benefit claim such as permanent total disability, retirement or death, SSS states that the outstanding balance including interest and penalties is deducted from the final benefit proceeds.
Does the family have to pay the Salary Loan from their own pocket?
The current SSS Salary Loan rule describes recovery through collection, deduction or withholding from SSS benefits due to the member or beneficiaries.
For most families, the practical issue is therefore: “How much will SSS deduct from the final benefit proceeds?” rather than assuming every heir must personally settle the member’s loan. If there is an unusual estate, fraud, disputed-balance or other legal issue, ask SSS or obtain case-specific legal advice.
What if the member died before the Salary Loan maturity date?
Do not assume the loan disappears because the member died before the original loan term ended.
The current Salary Loan rule separately states that when beneficiaries file a final benefit claim such as death, the outstanding Salary Loan balance, including interest and penalties, shall be deducted from the final benefit proceeds.
Before estimating the deduction, verify the actual loan balance
Do not use the original amount borrowed as the expected deduction. The outstanding balance can be different because of posted payments, remaining principal, interest and penalties.
What the family should gather
- Latest available Salary Loan Statement of Account or My.SSS loan record
- Payroll deductions made by the deceased member’s employer, if applicable
- PRN payment receipts or online-payment confirmations
- Any payment-posting email or transaction reference
- Any SSS notice showing the final outstanding balance or deduction
What if the member paid but some payments are missing?
A missing valid payment can make the outstanding balance look higher than expected. Do not automatically accept the displayed balance if you have evidence that a payment was made but never posted.
Employer payroll deduction
Keep payslips or employer records and verify whether the deducted amount was actually remitted to SSS.
Direct PRN payment
Keep the PRN, amount, date, collecting channel and transaction receipt/reference.
Balance still looks wrong
Request payment tracing or reconciliation before relying on the apparently higher outstanding balance.
Death Benefit Offset Planner
Use this only after you have a gross SSS Death Benefit estimate and an outstanding Salary Loan balance. It does not calculate the Death Benefit itself.
Planning estimate after Salary Loan deduction
This is only a planning subtraction. Other case-specific SSS adjustments or deductions can still change the final amount actually released.
